Section 4(f) is a Federal statute intended to preserve and protect parks, recreational areas, wildlife refuges, or
public and private historical sites. The law regulates the use of land from these protected resources by
transportation projects.
For the Sellwood Bridge Project, Multnomah County is proposing that a Section 4(f) “de minimis“ finding be made
for the project at both Powers Marine and Willamette Moorage Parks. De minimis means that, overall, the project
does not adversely affect the activities, features, and attributes of the parks, after taking into account the
positive effects to the parks resulting from mitigation and enhancement actions to be performed to offset impacts.
The proposed de minimis finding is pending City of Portland approval.
Multnomah County proposes the de minimis finding at Powers Marine Park in consideration of the following anticipated
impacts and subsequent mitigation/enhancement actions to be performed at the park by Multnomah County as part of the
Sellwood Bridge Project:
Impacts
Approximately 1.02 acres of natural area at Powers Marine Park will be utilized to construct the project;
including the existing parking space area.
Mitigation/Enhancement Actions
- The County will replace land to be converted to transportation use by the project to ensure no net loss of
parkland.
- The County will design and implement fill removal, planting, and stream restoration at two streams in the park.
- The County will design and implement a parking and pedestrian access plan for Powers Marine Park to include the
provision of a minimum of seven (7) vehicle parking spaces.
Multnomah County proposes the de minimis finding at Willamette Moorage Park in consideration of the following anticipated
impacts and subsequent mitigation/enhancement actions to be performed at the park by Multnomah County as part of the
Sellwood Bridge Project:
Impacts
Approximately 0.35 acres of natural area at Powers Marine Park will be utilized to construct the project.
Mitigation/Enhancement Actions
- The County will replace land to be converted to transportation use by the project to ensure no net loss of
parkland.
- The County will construct a new paved bicycle/pedestrian path between the existing Macadam Bay Homes driveway and
SW Miles Avenue (this will extend the already planned path, resulting in a safe and continuous off-street paved path
from the Sellwood to the existing paved multi-use trail located in Willamette Park.
- The County will replace the existing Stephens Creek culverts with a fish and wildlife-friendly passage.
- The County will provide 24” and 36” vegetated steepened slopes along the bicycle/pedestrian trail to minimize visual
and aesthetic impacts to the park.
Comments regarding the proposed de minimis findings at Powers Marine and Willamette Moorage Parks are due by May 7, 2010.
